1. Scope
1.1 These General Terms and Conditions (hereinafter referred to as "GTC") of Mintbeauty LLC (hereinafter referred to as the "Seller") apply to all contracts for the delivery of goods that a consumer or business entity (hereinafter referred to as "Customer") concludes with the Seller in relation to goods presented in the Seller’s online store. Any terms or conditions of the Customer that conflict with or deviate from these GTC are expressly rejected unless otherwise agreed in writing.
1.2 For the purposes of these GTC, a "Consumer" is any individual entering into a transaction for purposes that are predominantly outside their trade, business, or profession. A "Business Entity" is a natural or legal person, or a partnership with legal capacity, that enters into a transaction as part of its trade, business, or professional activity.
2. Formation of the Contract
2.1 The product descriptions in the Seller’s online store do not constitute binding offers by the Seller but serve as invitations for the Customer to submit a binding offer.
2.2 The Customer can submit an offer via the Seller’s online order form. By placing the selected goods in the virtual shopping cart and completing the electronic ordering process, the Customer makes a legally binding offer for the goods in the cart by clicking the final order button. Offers may also be submitted by phone or email.
2.3 The Seller may accept the Customer's offer within five days by:
- Sending a written order confirmation or one in text form (fax or email), in which case the receipt of the confirmation by the Customer is decisive;
- Delivering the ordered goods, in which case the receipt of the goods by the Customer is decisive;
- Requesting payment from the Customer.
The contract is concluded at the time one of these events occurs. The acceptance period begins on the day following the submission of the offer by the Customer and ends on the fifth day thereafter. If the Seller does not accept the offer within this period, the offer is considered rejected, and the Customer is no longer bound by it.
2.4 If PayPal is selected as the payment method, the payment processing is carried out by PayPal, Inc., in accordance with PayPal’s terms of service. Upon completion of the payment process, the Seller automatically accepts the Customer’s offer at the moment the order is submitted.
2.5 If "Amazon Payments" is chosen as the payment method, the payment process is handled by Amazon Payments, Inc., under its terms of use. Upon confirming the payment process, the Seller automatically accepts the Customer’s offer.
2.6 The contract text is stored by the Seller and sent to the Customer in text form (e.g., email) after the order is placed. Customers with an online account can access their order details via their password-protected accounts.
2.7 Prior to submitting a binding order, the Customer can identify and correct input errors using standard keyboard and mouse functions or browser zoom features.
2.8 Contracts are only available in English.
2.9 Order processing and communication with the Customer typically occur via email. The Customer must ensure their provided email address is accurate and capable of receiving emails from the Seller, including checking spam filters.
3. Right of Withdrawal
3.1 Consumers generally have a right to withdraw from the contract.
3.2 Detailed information about the right of withdrawal is provided in the Seller's withdrawal policy.
4. Prices and Payment Terms
4.1 Unless otherwise indicated, prices listed include applicable sales tax. Any additional shipping costs are separately displayed in the product descriptions.
4.2 International orders may incur additional costs such as bank transfer fees or import taxes, which are the Customer’s responsibility.
4.3 Payment methods are displayed during checkout.
4.4 Payment via bank transfer is due immediately unless otherwise agreed.
5. Delivery and Shipping Terms
5.1 Orders are shipped to the address provided by the Customer unless agreed otherwise.
5.2 If delivery fails due to the Customer’s fault, the Customer is responsible for associated costs unless they validly exercise their right of withdrawal.
5.3 In-person pickup is not available.
6. Retention of Title
The Seller retains ownership of delivered goods until payment is made in full.
7. Liability for Defects (Warranty)
7.1 Warranty claims follow applicable U.S. law.
7.2 Customers are encouraged to report visible transport damage to the carrier and notify the Seller, though this does not affect their warranty rights.
8. Governing Law
All legal relationships between the parties are governed by the laws of the United States, excluding international sales laws (CISG). Consumer-specific mandatory laws in their state of residence remain unaffected.
9. Jurisdiction
If the Customer is a business entity, legal disputes are subject to the jurisdiction of the Seller’s registered office. For international business Customers, disputes fall under the jurisdiction of the Seller’s office unless otherwise agreed.
